FDIC ANNOUNCES THE TRANSACTION ACCOUNT GUARANTEE PROGRAM AND INCREASES INSURANCE LIMITS

On October 14, 2008, the FDIC announced its new Transaction Account Guarantee Program as part of the Temporary Liquidity Guarantee Program. Franklin Bank is participating in the Transaction Account Guarantee Program, under which all non-interest-bearing transaction accounts — business or personal — are fully insured by the FDIC for the entire amount in the account. The FDIC expects the program to give greater confidence in the soundness and safety of these accounts, such as those used for payment processing or payroll, regardless of their size.

Coverage under the new program is in addition to the coverage announced under the Emergency Economic Stabilization Act of 2008. That Act temporarily raised the basic limit on federal deposit insurance coverage from $100,000 to $250,000 per depositor. The increased coverage provisions under both the Transaction Account Guarantee Program and the Emergency Economic Stabilization Act of 2008 are scheduled to expire on December 31, 2009, when the basic deposit insurance limit will return to $100,000.

On November 7, 2008, Franklin Bank, SSB, Houston, TX was closed
by the Texas Department
of Savings and Mortgage Lending. Subsequently,
the Federal Deposit Insurance Corporation (FDIC) was named Receiver. No advance notice is given
to the public when a financial institution is closed.

All deposit accounts have been transferred to Prosperity Bank, Houston, TX.  For more information
